These Terms & Conditions (hereinafter “Terms”) set forth the conditions for the use of all services provided by KAGARIBI Inc. under the brand name “NINJAYA” (hereinafter “Services”). By completing a reservation or receiving our Services, the User is deemed to have agreed to all provisions of these Terms. These Terms shall prevail over any verbal explanations provided by our staff.
A service contract is formed when our system sends a reservation confirmation email. If you do not receive this email, please contact our Concierge Desk immediately. Failure to contact us and not showing up on the scheduled day will be treated as a No-Show.
Article 2: Fees & Payment
As a general rule, all Service fees must be paid in advance at the time of booking. Any extension fees or additional optional costs incurred on the day of the tour must be settled in full on-site upon the completion of the Service.
Article 3: Cancellation, Modification & Early Termination
1. Cancellation Policy
To guarantee the highest quality of experience, we fully secure the schedule of your exclusive guide and premium vehicle at the time of booking. Therefore, cancellations made for the User’s convenience are subject to the following cancellation fees.

More than 48 hours prior: Free of ChargeFull refund or release of the credit card authorization hold.

Between 24 and 48 hours prior: 50% of the Total Fee50% will be charged to your registered credit card.

Within 24 hours (Including No-Shows): 100% of the Total FeeThe full amount will be charged to your registered credit card.
2. Rescheduling Policy
Our system does not accept date or time modifications once a reservation is finalized. If you wish to change your booking, please cancel the current reservation and make a new one. Please be advised that the aforementioned cancellation policy will apply.
3. Early Termination by User
If you wish to terminate the tour early due to illness or urgent matters, please inform your guide. Your health and safety are our utmost priority. However, please note that no refunds will be issued for the unused portion of the reserved time.
Article 4: Late Arrival & Service Shortening
Our Services operate strictly on a scheduled time basis. To prevent disruptions to other guests’ itineraries, we enforce the following policies regarding late arrivals.
- Up to 5 Minutes Late: We will endeavor to provide the regular service in its entirety.
- Between 5 and 10 Minutes Late: The Service will commence upon arrival, but will conclude at the originally scheduled time. The overall duration will be shortened, and no refunds will be provided for the lost time.
- Over 10 Minutes Late: The Service will be significantly shortened or the route altered. If the delay impacts the subsequent reservation, making the tour undeliverable, it will be classified as a Same-Day Cancellation (100% charge).
Article 5: Suspension due to Inclement Weather
We reserve the right to suspend operations if we determine that safe delivery of the Service is compromised due to severe weather conditions, such as typhoons, heavy rain, or official weather warnings. In principle, we will notify you via your registered contact details at least one hour prior to the scheduled start time. In the event of a cancellation initiated by us, no cancellation fees will apply (full refund). However, we hold no liability for any secondary damages or costs incurred (e.g., travel or accommodation expenses).
Article 6: Refusal of Service
We reserve the right to refuse or immediately terminate the Service, without refund, if the User exhibits any of the following conditions or behaviors:
- Being severely intoxicated or under the influence of illicit substances.
- Engaging in abusive language, violence, or intimidating behavior toward our staff.
- Committing acts that violate public order, morals, or the law.
- Being pregnant, or accompanying infants without full neck support (strictly enforced for safety reasons).
- Bringing pets that pose a safety risk, or carrying oversized luggage that exceeds the vehicle’s secure storage capacity.
Article 7: Disclaimer of Liability
Except in cases of gross negligence or intentional misconduct by our company, we disclaim liability for any damages incurred by the User, including but not limited to:
- Soilage or damage to clothing or personal belongings during the tour. We strictly hold no liability for damage to fragile items or precision equipment inside luggage caused by the natural vibrations of the ride.
- Loss or failure of photographic data due to equipment malfunction (liability is capped at the refund of the photography fee, if applicable).
- Inability to follow the planned route due to sudden traffic restrictions or heavy congestion.
- Injuries, sudden illnesses, falls resulting from the User’s carelessness, or the loss of personal valuables.
Articles 8 – 11: Supplementary Provisions
Art 8. Damages: In the event we are found liable, our maximum compensation shall not exceed the Service fee paid by the User.
Art 9. Governing Law: These Terms shall be governed by the laws of Japan, with the Kyoto District Court holding exclusive jurisdiction. The original Japanese text shall prevail in case of discrepancies.
Art 10. Portrait Rights: Photographs will only be published on our official SNS channels with the explicit consent of the User.
Art 11. Privacy: We will not disclose personal information to third parties without prior consent, except as required by law.
